About this deal

The statutory duty to children includes the need to demonstrate that both asylum claims and consideration of exclusion issues are dealt with in a timely and sensitive way where children are involved. In accordance with Section 55 and our obligations under the UN Convention on the Rights of the Child, the best interests of the child must be considered as a primary consideration (although not necessarily the only consideration) when making decisions affecting children. In the context of exclusion this is most likely to apply in cases where they are dependent on the main claimant (see section exclusion and dependants). A full list of those countries required to submit ‘prima facie’ evidence can be found at Extradition: processes and review - GOV.UK (www.gov.uk).

There are internal systems for reporting violent incidents (collated nationally), recording noteworthy events or behaviour on each wing and communicating these to each new shift or the control room. Further measures include control and restraint training (C&R), provision of alarms throughout the wings, personal alarms and radios, and anger reduction classes/therapy. Also directly applicable is the Building (Scotland) Act 2003 which creates the Building (Scotland) Regulations 2004. These Regulations are fully applicable to all prison establishments within Scotland due to removal of Crown Exemption. However, CIFRA act as Crown Inspectors whenever a relaxation is being considered to achieve compliance with the Building Regulations. A proportion of cells in prisons will be 'safer' cells. These cells meet a more rigorous standard of design (laid down in a Prison Service Instruction) that minimises the risk of suicide via a ligature. The number of safer cells will be dependent on risk. Safer cells form only part of the wider management of risk from suicide. permission to stay as a refugee’ means permission to stay (previously referred to as ‘leave to remain’) granted under paragraph 339QA of the Immigration Rules to an individual with refugee status in the UK. This includes both permission to stay as a refugee and temporary permission to stay as a refugee. The long term objective of the Prison service is to introduce engineering control measures such as in cell fire detection and sprinkler systems, but due to age and condition of the prison estates this will take a number of years to achieve. Fire Precautions Scotland In Scotland, there are also 3 operational grades of uniformed officer - C, D & E. Whereas grades C & D wear only 'HMP' on their epaulettes, those designated as 'First Line Managers' wear two pips. The overall grade structure is A-I with 'I' being the most senior. Grades C – E also contain non-operational staffs who wear civilian clothes rather than uniform. Uniform is not worn by middle and senior managers in grades F – I).

The UK is no longer bound by the EU Qualification Directive but it provides useful comparison for how other European countries approach exclusion and refoulement. Immigration Rules Second, the 2022 Act defines what it means for a claimant to have a well-founded fear of persecution. It creates a new statutory framework for decision makers to follow when assessing whether a claimant has a well-founded fear of persecution in accordance with Article 1(A)(2) of the Refugee Convention. We can also use this equation to find the expected exam score based on the number of hours that a student studies. For example, a student who studies for 10 hours is expected to receive an exam score of 85.15: has committed a serious non-political crime outside the country of refuge prior to admission to that country as a refugeeNevertheless, the health and safety standards applied to prison workshops and farms should be the same as those in the commercial sector. Prisoners who are not deemed to be employees are entitled to the protection afforded by the Health and Safety at Work etc Act 1974 (HSW Act) s.3(1). A person convicted by a final judgment of a particularly serious crime is considered to constitute a danger to the community of the United Kingdom if he is: Those providing medical treatment have a special position under international humanitarian law. This position does not automatically take them outside of the scope of exclusion in Article 1F(c) but the courts have found that it may weigh against a finding of complicity. MH (Syria) v Secretary of State for the Home Department [2009] EWCA Civ 226 stated:

F-statistic & p-value: The F-statistic ( 63.91) and the corresponding p-value ( 2.253e-06) tell us the overall significance of the regression model, i.e. whether explanatory variables in the model are useful for explaining the variation in the response variable. Since the p-value in this example is less than .05, our model is statistically significant and hours is deemed to be useful for explaining the variation in score. The residuals appear to be randomly scatted around zero and don’t exhibit any noticeable patterns, so this assumption is met. The Prison Service is made up of 2 separate organisations: HM Prison Service (HMPS) in England and Wales, and the Scottish Prison Service (SPS). The former is part of NOMS, under a Chief Executive Officer, whilst the latter is an Agency of the Scottish Government, with a Chief Executive. Both prison services are held to be part of the Crown and therefore subject to Crown administrative enforcement procedures. has committed a crime against peace, a war crime, or a crime against humanity, as defined in the international instruments drawn up to make provision in respect of such crimes
